GoLux Terms of Use & Privacy Policy

This combined Terms of Use & Privacy Policy (“Agreement”) governs your access to and use of the GoLux mobile application (the “App”) and related services provided by New Era Holidays Sdn Bhd (“we”, “our”, or “us”). By downloading, installing, or using the App, you agree to be bound by these terms. If you do not agree, please stop using the App immediately.

1. Acceptance of Terms of Use

• You must be at least 18 years old and legally capable of entering binding agreements.
• We may update or amend this Agreement at any time. Continued use constitutes acceptance of the new version.

2. Services Provided

The App enables users to access luxury chauffeur and vehicle rental services, pick-up/drop-off assistance, and related concierge support. All bookings are subject to confirmation and availability.

3. Your Responsibilities

• Provide accurate and current information when registering or booking.
• Do not use the App for unlawful, fraudulent, or abusive purposes.
• Follow all vehicle and chauffeur policies (no smoking, no hazardous materials, etc.).
• You are responsible for any damages or additional costs due to misconduct or negligence.

4. Booking & Payment

• Bookings constitute requests for service and are confirmed subject to availability.
• Payments can be made by credit/debit card, transfer, or other accepted methods.
• Deposits may be required; cancellation and refund policies apply as per your booking.
• We are not liable for delays due to traffic, weather, or other circumstances beyond our control.

5. Intellectual Property

All content in the App (text, images, logos, graphics, software) is owned by us or our licensors. You may not reproduce or distribute any material without prior written consent.

6. Limitation of Liability & Indemnification

• We are not liable for any indirect, incidental, or consequential damages arising from your use of the App or our services.
• You agree to indemnify and hold harmless New Era Holidays Sdn Bhd, its officers, employees, and affiliates from any claim or loss related to your actions or breach of this Agreement.

7. Privacy & Data Protection

7.1 Information We Collect

• Personal Information: Name, contact details, identity documents, payment details.
• Usage Data: App usage statistics and access logs.
• Location Data: Collected (with consent) for booking and navigation purposes.
• Device Info: Device model, OS, and identifiers.

7.2 How We Use Information

• To process bookings, rentals, and customer support.
• To improve App performance and functionality.
• To communicate updates, offers, and service-related messages.
• To comply with legal and regulatory obligations.

7.3 Sharing of Information

We do not sell or rent personal data. Information may be shared only with:

• Trusted partners (payment processors, travel providers)
• Government authorities if legally required
• Internal departments of New Era Holidays Sdn Bhd

7.4 Data Security & Retention

We use appropriate safeguards to protect your data, but no method is 100% secure. Data is retained only as long as necessary for legitimate purposes.

This Agreement is governed by Malaysian law. Any disputes will be resolved exclusively in the courts of Malaysia.

9. Severability & Entire Agreement

If any clause is found invalid, the remainder remains effective. This document constitutes the entire agreement between you and us regarding use of the App and related services.
